Kyle Flack: Jury Recommends Death Sentence For Man Who Killed Three Adults And A Baby On Kansas Farm

A jury recommended on Thursday a death sentence for Kyle Flack, 30, the man who shot and killed two men, a woman, and her 18-month-old baby on a Kansas farm, the Daily Mail is reporting.

Flack was found guilty of capital murder in the deaths of Kaylie Bailey, 21, and her daughter, Lana, as well as Andrew Stout, 31, who was in a relationship with Bailey, and his roommate Steven White, also 31. The roommates both stayed in Ottawa, 50 miles from Kansas City, a place that Flack visited sometimes. Flack killed them all and hid their bodies but stuffed the remains of the little girl in a suitcase and dumped it in a creek.

A formal sentencing is set for May 18 after District Judge Eric W. Godderz reviews the recommendation. The only other alternative is a life sentence without possibility of parole.

Prosecutors established that White was the first one killed on April 20, 2013. His body was found in an outbuilding near the farmhouse under piles of junk. Stout was killed April 29 and left in a bedroom in the farmhouse under a pile of clothes. Kaylie Bailey and her daughter were killed May 1; Bailey was buried underneath a pile of clothes, her daughter’s body was found in a suitcase floating near the Franklin County line. Paperwork and diapers were found near the scene. Bailey was found bound with hands behind her back and nude from the waist down.

After the murders, Flack drove Bailey’s car to Emporia and stayed with friends. He ditched the car on the opposite side of town far from where he was staying. But surveillance cameras picked him up and also saw when he was getting rid of items belonging to the mother and daughter, dumping them in a trash can. When he was picked by police, black zip ties where found in his backpack, the same kind that was used to tie up Kaylie Bailey’s hands.

Prosecutors presented two weeks of testimony during Flack’s trial. The defense did not have any witnesses; the only person that would have spoken, Flack’s mother, Tammy McCoy, was stopped at the request of Flack. She was supposed to reveal her sexual abuse and how it had impacted on her son’s mental health. But Flack did not want her mother revealing the abuse in front of people. Even when Flack was told that it was in his best interest to have his mother speak for him so as to avoid the death penalty, he still refused her to take the stand.

A therapist tried to focus on Flack’s state of mind and that he suffered bouts of schizophrenia and paranoia, stating that he found it hard to show regard or empathy for other people even though his IQ was above average. Psychiatrist William Logan said he never knew his father because his mother was raped. Flack himself was allegedly raped by his stepfather when he was 6. He went on to say his grandmother had a toxic attitude towards him and would frequently call him terrible names. The psychiatrist says that he grew up with no direction of what was good or bad and had no support systems. Flack’s lead defense attorney, Timothy Frieden, encouraged the jury to recommend life without parole saying that the man who murdered four people was not “really a monster”.

Jurors had deliberated and found Flack guilty in the quadruple murder trial. He was guilty of possessing a firearm. He was also convicted of a single count of capital murder in the fatal deaths of Kaylie Bailey and her daughter, Lana Bailey. The jury found him guilty of first-degree murder in the death of Steven White and second-degree murder of Andrew Stout.
