Robert Leroy Wilson, 31, faces 30 years behind bars for the beating death of Jack Kirby Garcia, 9, whom he handcuffed to a chair and beat mercilessly for “stealing” a piece of birthday cake, according to Your4State. He pled guilty to second-degree murder. The incident occurred on June 30, 2015, and the boy died on July 5, 2015, of his injuries at Children’s National Medical Center in Washington, D.C., where he was flown from Meritus Medical Center in Hagerstown, Maryland.
The child was the son on Wilson’s girlfriend, Oriana Garcia, 26, who was not home at the time of the fatal beating but did prevent paramedics from reaching her son earlier on the day of his death. Her brother, Jacob Barajas, had called 911 and removed the handcuffs from the boy when he felt the beating was too severe. Jack’s mother met Community Rescue Service personnel outside and explained that their help was not needed and that her son was simply congested.
Meanwhile, Jack had been dying for hours, the result of fatal blows that had accrued after he took a piece of birthday cake without permission. His mother’s boyfriend handcuffed him and preceded to beat him multiple times, with the boy saying, “Please stop.” Court documents note that he hit the boy several times in the stomach, at which time Barajas released the handcuffs. The boy fell to the floor, where he lay motionless and silent.
Prosecutors in the case said Jack was routinely deprived of food if Wilson felt the boy hadn’t exerted himself enough doing chores, and he was handcuffed to a chair or beaten with a bamboo sword if he took food without permission, the evidence and testimony showed, according to the Chicago Tribune.
The judge that presided the trial of Robert Wilson, M. Kenneth Long, showed sadness over the child’s futile life and death, noting that he had no quality of life in the apartment prior to his death.

“What a bleak existence this little person had.”
Detectives said that when the boy’s mother arrived home, Wilson apologized to her profusely. She ultimately denied her son the medical care that may have saved his life. When emergency services were summoned again at 10:37 p.m. to the 500 block of Lynnhaven Drive, Jack was unresponsive and not breathing. At the time of his death, the boy also had various injuries in multiple stages of healing, with bruises on his face, neck, torso, arms, and head.

Detectives are investigating the other acts of alleged child abuse prior to the boy’s death. Meanwhile, his mother, Oriana Garcia, and his uncle, Jacob Barajas, will face charges of second-degree murder in May. The trial is to be held in Hagerstown.
The boy’s birthday was within a week surrounding the incident. It is unclear if the cake was his. Apparently, no other children were living in the home at the time of the 9-year-old’s death.
Wilson admitted that he caused the child’s injuries that ultimately resulted in death on July 5, but other charges against him have been dropped due to a lack of evidence. Prosecutors ended up dropping seven charges of abuse, neglect, and reckless endangerment in the trial concerning Jack Garcia’s beating death.
Many area residents were outraged that the convicted murderer received only 30 years behind bars, believing it should have been a life sentence. With good conduct, Wilson could be a free man at less than 60-years-old.
